The W.A. Lee Equity Lecture is an annual event which honours the achievements of eminent solicitor and scholar, Mr W.A. "Tony" Lee.

The lecture is a collaboration between QUT's Centre for Non-profit Studies and Philanthropy, Faculty of Law and the Queensland Community Foundation. Sponsors include the Queensland Law Society and Proctor, the Bar Association of Queensland, Domaine Chandon Australia and LawBook Company.

Topic

The Equitable Lien and Personal and Proprietary Claims Against Trustees in Breach

There is some dispute in recent judicial and academic literature whether an equitable lien on the proceeds of a breach of trust is best understood as a proprietary enforcement of a personal claim against a trustee for breach of trust, or in some other manner.  This lecture will examine the issues around this dispute, in the more general context of remedies for breach of trust.
